I feel like the Roe vs. Wade (1)>>leak was an orchestrated plot to subvert the main focus of the midterm on the struggling working class and economy to abortion. This leak was meant to intimidate the Supreme Court into backing down. I see the high fences have gone up around the Supreme Court and I'm reminded that one of the *other* reasons the Court is so pissed about the leak was that their actual plan was to kill Roe v. Wade and then scurry out of town so they didn't have to deal with anybody. (1.2)>>Last year I wrote that Roe V Wade was going to bite the dust in 2022 . Which, as we are frequently told, is not found anywhere in the text of the Constitution. How "abortion" became legal is more conjuncture than real . Its base was shaky from the start . As the country grapples with the release of the draft, many people are revisiting the provisions in the (2)>>Constitution the court relied upon handing down the 1973 ruling, including the 14th Amendment. The 14th Amendment applied the rule of "equal protection" clause, that requires that everyone must be equally protected and equally treated under the law. Now the term "everyone " seemed to have left out the unborn . So the “right to privacy” that protects a pregnant woman’s choice whether to have an abortion. However, this right is balanced against the government’s interests in protecting women's health and protecting “the potentiality of human life.” The Texas law challenged in this case violated this right. Basically I don't understand the argument that the 14th amendment gives a general right to privacy that also somehow grants a right to abortion.Like is the idea that the 14th amendment always included a universal right to abortion, but before 1973 all US legal scholars were reading it wrong lol? So it seems to me that repealing Roe v Wade is the correct reading of the law. It's not the 14th in isolation. The 1st, 3rd, 4th and 5th Amendments are collectively referred to as giving a right to privacy, a right to not associate and keep your life private. The 9th amendment states that the constitution will not invalidate any other rights granted to the citizens. Thus, there are implied rights that we have but are not explicitly mentioned in the Constitution and a general right to privacy. The Roe court read an implied right to an abortion into the category of "right to privacy." The 14th amendment states that your liberty will not be abridged without due process.Thus the right to an abortion was seen as requiring appropriate government protection. There’s lots of pressure on both parties especially the DNC (since they are in charge) to address things like inflation, the great worker shortage, the affordable housing crisis, and the empty promises of student loan forgiveness & marijuana decriminalization. Now instead of actually having to address those things and come up with solutions the main focus of midterms will now be abortion. Workers will be forgotten about because the DNC & GOP are too busy playing good cop bad cop and the DNC takes no preventative action to stop things like this happening so they can use them as a wedge/talking point for elections.
